Press statement | 08.10.2018 Requests for access to information shhould be processed in accordance with the Law on Freedom of Access to Information by adopting an appropriate solution Access to Information The Ombudsmen of Bosnia and Herzegovina are based on the appeal of Miodrag Garic, and after he did not realize the right to us with the Law on Freedom of Access to Information of the Federation of Bosnia and Herzegovina, he issued a recommendation to the Canton 10 Agency for Privatization to take effective measures and actions to make a decision upon request for access to information submitted on April 9, 2018 years. The Ombudspersmen point out that Article 4 of the Law on Freedom of Access to Information of the Federation of Bosnia and Herzegovina prescribes that every natural or legal person has the right to access information. Upon receipt of requests for access to information, the competent public authorities are obliged to take all necessary actions in order to communicate the requested information. The obligation of each public authority is to communicate the information in its possession and this right may be limited only in the manner and under the conditions laid down by the Law on Freedom of Access to Information of the Federation of Bosnia and Herzegovina, which is lex specialis. The Ombudspsmen point out that in accordance with Article 14 of the Law on Freedom of Access to Information of the Federation of Bosnia and Herzegovina, the competent public authorities are obliged to make a decision on the request for access to information and submit the requested documentation to the applicant. By failing to provide a proper solution to the submitted request, the competent public authorities also violate the rights of the applicants referred to in Articles 10 and 13 of the European Convention for the Protection of Human Rights, each of which guarantees the freedom to receive information and the right to an effective remedy.
