Public announcement on the political appointments of public functions holders

The institution of the Ombudsman for Human Rights of Bosnia and Herzegovina, acting on the appeal of D.J. from Banja Luka, considered the question of appointing managers of public enterprises, institutions and bodies, who are appointed as party candidates in public positions.

The Ombudsmen primarily emphasize that such practice that is present throughout Bosnia and Herzegovina excludes "non-partisan" candidates, and discrimination based on political orientation is expressly prohibited by the Constitution, Labor Law and international conventions that have direct application in the domestic legal system.

Furthermore, one of the key requirements in the process of combating corruption, establishing the rule of law and European integration is the depolitization of public administration, which implies the appointment of persons to the highest public functions, especially in public enterprises, institutions and agencies, which are not party candidates.

Finally, it is unacceptable that management of public resources is entrusted to persons only on the basis of their party affiliation, rather than on the basis of quality and expertise, and the consequences of such negative selection are present and obvious every day.

The Ombudsmen at the same time invite competent criminal prosecutors to examine to what extent such appointments constitute trafficking by influence and other violations of the Criminal law.
