Press statement | 11.02.2020 Ombudsmen support the adoption of a law on trial within a reasonable time Judiciary - Illustration Ombudsmen of Bosnia and Herzegovina Prof. Dr. Ljubinko Mitrović, Dr. Jasminka Džumhur and Nives Jukić welcome the Law on the Protection of the Right to a Trial within a Reasonable Time, which was urgently submitted by the Government of the Federation of Bosnia and Herzegovina to parliamentary procedure. Ombudsmen in the previous period, not only through annual reports, but also other activities, pointed to a large number of cases pending before the courts in Bosnia and Herzegovina. The Ombudsmen came to this knowledge by acting on complaints from citizens and ex officio, in which they most often determine whether, in proceedings brought before the courts in Bosnia and Herzegovina, there has been a violation of Article 6 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, which guarantees the right to a trial before an independent and impartial tribunal established by law, the right to effective access to that tribunal, and the right to a fair and public hearing within a reasonable time. The right to a trial within a reasonable time is an inseparable part of the right of Article 6 of the European Convention. Recognizing the fact that the judiciary is the guarantor of law enforcement and most important in protecting the rights and freedoms of citizens, the Ombudsmen believe that the adoption of the Law on the Protection of the Right to a Trial within a Reasonable Time certainly contributes to strengthening the rule of law and protecting the individual in the enjoyment of human rights.
