Non-cooperation with the Ombudsman Institution

Human Rights Ombudsmen of Bosnia and Herzegovina received a complaint on May 23, 2019 from Sead Mulahmetovic from Tuzla. The complaint was registered with the Ombudsperson Institution under number Ž-BR-05-126 / 19. The complainant identified the City of Tuzla, the Inspection Service, as the responsible party.

The complainant's allegations relate to the work of the City of Tuzla, the Inspection Service, the construction inspector. Inspection of the submitted documentation revealed that Sead Mulahmetović addressed the building inspection on 17.05.2019 by an act with the title "Subject: Application: Illegal work of the Tuzla construction inspection".

Following the receipt of the complaint, the Ombudsman Institution of Bosnia and Herzegovina addressed on 28 May 2019 a request for a statement to the City of Tuzla, Inspection Service.

As the act of 28.05.2019 was not answered, the Ombudsman Institution sent urgencies on 11.07.2019 on 23.09.2019 and 13.11.2019.

In the present case, the responsible party did not comply with the provisions of the Law on Human Rights Ombudsman of Bosnia and Herzegovina by ignoring the request of the Institution of Human Rights Ombudsman of Bosnia and Herzegovina, and the Ombudsmen of Bosnia and Herzegovina, in accordance with the provisions of Article 32 of the Law on Human Rights Ombudsman Human Rights Ombudsman of Bosnia and Herzegovina issued recommendation number: P-294/19 on 23.12.2019 recommending:

"To the City of Tuzla, Inspection Service Inspectorate of Urban Planning, Market, Tourism and Hospitality, road and thermal inspections

1. Immediately upon receipt of this recommendation, establish cooperation with the Human Rights Ombudsman of Bosnia and Herzegovina, in the manner prescribed by the Law on the Ombudsman for Human Rights of Bosnia and Herzegovina, and submit the requested statement, as stated in the acts of 28.05.2019. g., 11.07.2019, 23.09.2019, and 13.11.2019. years.
2. Within 20 (twenty) days from the date of receipt of this recommendation, inform the Ombudsman of Bosnia and Herzegovina of the manner in which this recommendation is implemented. "
