Violation of the right to work

Human Rights Ombudsmen of Bosnia and Herzegovina on 24.09.2019 received a complaint by Svjetlana Lazić concerning the Municipality of Stanari for illegally conducted Public vacancy for filling vacancies in the Municipal Administration of the Municipality of Stanari, number: 02-102-13/19 published in Dnevni list Glas Srpske and in the Official Gazette of the Republika Srpska, No. 17/19 of 5 March 2019, which violated her right to work.

In the course of the investigation procedure, the Ombudsmen found that the complainant's allegations had been established and that her right to work had been violated, following an analysis of the complaint, the response of the competent authority and legal regulations. The aforementioned was also established by the second instance body, the Board of Appeal, whose decisions of 10.06. and of 18.07.2019 (upheld the appeal of the nominee, annulled the decision of the Mayor of Stanari on admission to the permanent employment of the selected candidate after the competition and returned the case to the first instance body for retrial), the first instance organ - the Municipality of Stanari did not act.

On 12.11.2019, the Ombudsmen of Bosnia and Herzegovina sent Recommendation No. P-253/19 to the Municipality of Stanari to act on the instructions of the second instance body, Decision of the Board of Appeal of 10.06. and 18.07.2019 and the Administrative Inspectorate to take all measures within its jurisdiction in order to monitor the actions/non-attendance of the first instance authority and initiate misdemeanor proceedings. A response to the recommendation was not provided.
