Recommendation to the Basic Court of Banja Luka

On 8 October 2018 the complainant addressed the Ombudsman for Human Rights of Bosnia and Herzegovina with a complaint related to the failure of the Basic Court of Banja Luka in case number 71 0 Rs 261418 17 Rs, for violation of employment rights, initiated on the complaint of the complainant against the defendant "Nova DI Vrbas “doo Banja Luka.

The complainant states that the lawsuit was received in court on 1 June 2017. and that until the moment of making the recommendation of the Ombudsman of Bosnia and Herzegovina, the decision has not been made. The complainant points out that her case is unnecessarily protracted, especially as it is an urgent procedure.

Following the investigation procedure, on 26 November 2020, the Ombudsman of Bosnia and Herzegovina sent a Recommendation (P-107/20) to the Basic Court of Banja Luka::

- to take all necessary actions immediately after receiving the recommendation in order to make a decision in case number 71 0 Rs 261418 17 Rs and to inform the Institution of the Ombudsman of Bosnia and Herzegovina about the measures taken.

In its response of 17 December 2020, the Basic Court of Banja Luka stated, inter alia, that the length of the proceedings in this case was not the result of negligent work or inaction or illegal conduct of the Court, but the frequent tendency of the parties to resolve the dispute amicably..

The complainant on 5 April 2021. submitted to the Ombudsman of Bosnia and Herzegovina the Decision No. 71 0 Rs 261418 17 Rs dated 24 March 2021, which decided on her claim, whereby the Recommendation of the Ombudsman of Bosnia and Herzegovina was complied with.
