Recommendation concerning violation of right to access to information

On 11 December 2020, the complainant approached IHROBiH in connection with a violation of the right to access to information committed by Republika Srpska Airports JSC Banja Luka and concerning the access to information request dated 25 September 2020. While conducting the examination procedure, IHROBiH found that no response was provided pursuant to the Republika Srpska Freedom of Information Act.

Therefore, the human rights ombudspersons of Bosnia and Herzegovina issued Recommendation number P-89/21 on 10 March 2021, instructing the Director of Republika Srpska Airports JSC Banja Luka to do the following:

1. Respond to the complainant’s request immediately upon receiving this Recommendation, pursuant to Article 14 paragraph 4 of the Republika Srpska Freedom of Information Act;

2. Inform IHROBiH of the activities taken to implement the Recommendation within 30 days, counting from the day it is received.

The respondent party informed IHROBiH in document no 555-1-1/21 dated 28 April 2021 that they sent the response to the complainant’s access to information request dated 25 September 2020, in line with the recommendation issued. The issued recommendation is considered to be complied with.
