Recommendation concerning violation of right to access to information and lack of cooperation with Institution of Human Rights Ombudsman of Bosnia and Herzegovina

On 9 February 2021, the complainant approached IHROBiH in connection with a violation of the right to access to information committed by the Central Bosnia Canton Football Association and concerning the access to information request dated 19 January 2021. While conducting the examination procedure, IHROBiH found that no response was provided to the complainant pursuant to the Federation of Bosnia and Herzegovina Freedom of Information Act.

Therefore, the human rights ombudspersons of Bosnia and Herzegovina issued Recommendation number P-100/21 on 7 April 2021, instructing the Executive Board of the Central Bosnia Canton Football Association to do the following:

1. Upon receiving this Recommendation, respond to the complainant’s request without delay, pursuant to Article 14 paragraph 4 of the Federation of Bosnia and Herzegovina Freedom of Information Act;

2. Upon receiving this Recommendation, establish cooperation with IHROBiH without delay and provide the requested statement pursuant to Articles 23 and 25 of the Law on Human Rights Ombudsman of Bosnia and Herzegovina;

3. Inform IHROBiH of the activities taken to implement the Recommendation within 30 days, counting from the day it is received.

Given that the respondent party has failed to inform IHROBiH of the activities taken to implement the issued Recommendation, the case was closed. The Recommendation issued is considered not complied with.
