The Institution of the Human Rights Ombudsman of Bosnia and Herzegovina received a number of inquiries from citizens, as well as media inquiries regarding the possible introduction of a ban on entering public facilities for citizens without a vaccination status certificate, negative PCR or antigen test or a certificate of COVID-19.

Regarding the possible introduction of restrictions for unvaccinated citizens, the Ombudsmen of Bosnia and Herzegovina point out that when considering such measures restricting the right of citizens to move, it is necessary to determine whether it is necessary in a democratic society, whether there is a justified goal, whether there is proportionality between goals. and measures taken, and whether the same is based on law.

The ombudsmen believe that in this case the public interest is indisputable, as well as the legitimate goal, which is to protect the health of the population, but before making a decision it is necessary to consider the proportionality of measures with the set goal, and whether it is possible to achieve milder measures.

Also, before deciding on measures restricting human rights, an assessment of the needs and specifics of vulnerable social groups should be made, as well as an analysis of the impact of measures on exercising the rights of these groups (children, children with disabilities, chronically ill, elderly, people with disabilities). , residents of informal Roma settlements, women, homeless people, victims of domestic violence, persons deprived of liberty, etc.)

We remind you that on February 23, 2021, the Ombudsmen issued a Press Release, i.e., "Invitation to all levels of government for the prompt procurement of vaccines against corona virus", which is available on the website of the Ombudsman institution u in which they especially pointed out the importance of health care, which must be organized in such a way as to provide protection to the citizen in the most efficient way. In exercising the right to health care, states are obliged to make available technologies (medicines, equipment and interventions), including immunization. In connection with the above, the question justifiably arises as to whether the competent authorities procured vaccines in a timely manner and made them accessible to citizens.

The ombudsman certainly used the opportunity to inform the public about the case of Vavricka and others against the Czech Republic, in which the European Court of Human Rights found that the decision of the Czech authorities to introduce compulsory vaccination does not violate the European Convention on Human Rights. April 8 this year). Ombudsmen believe that the focus must be on the right of every individual to health care, but also on the right of others with who he is in contact.
