Recommendation to Čapljina Municipal Court

On 25 January 2022, IHROBiH received a complaint concerning violations of Article 6 paragraph 1 of the European Convention for the Protection of Human Rights and Fundamental Freedoms.

The complaint primarily concerns the excessive length of the judicial proceedings conducted by Čapljina Municipal Court. Following the investigation procedure in this specific case, IHROBiH found a violation of the right to a fair trial, noting that the case had not been finalised and had not taken legal effect for 13 years.

IHROBiH issued Recommendation no. P-136/22 on 4 May 2022, instructing as follows:

1. To take a decision in this case in keeping with the standards referred to in Article 6, paragraph 1 of the European Convention for the Protection of Human Rights and Fundamental Freedoms;

2. To inform IHROBiH of the outcome of this Recommendation within fifteen days from the day it is received.
