Recommendation to PI Hospital Travnik –comply with Freedom of Information Act

On 7 April 2022, the Institution of Human Rights Ombudsman of Bosnia and Herzegovina received a complaint filed by S.Č. concerning the exercise of the right to access information and designating PI Hospital Travnik as the respondent party.

IHROBiH considered the complaint and following the investigation procedure established a violation of the right in the case. The respondent party submitted to the complainant a statement concerning her FOIA request. As the competent body failed to comply with the Freedom of Information Act of the Federation of Bosnia and Herzegovina, on 17 June 2022, IHROBiH sent Recommendation no P-145/22 dated 17 June 2022 to the Director of PI Hospital Travnik, and it read as follows:

1. without reviewing the merits of the decision, to issue a decision at the request of the party requesting access to information which, in addition to other elements, is to comprise the legal remedy, so that the complainant could exercise her right to use it.

2. to inform IHROBiH of the implementation of this Recommendation within fifteen (15) days from the day it is received.
