Press statement | 28.11.2022 Recommendation to grant equal status to legal marriage and common-law marriage Human Rights Ombudsman of Bosnia and Herzegovina IHROBiH sent Recommendation P-290/22 to the Government of the Federation of Bosnia and Herzegovina, instructing it to take actions with a view to amending the Act on Special Rights of Recipients of War Acknowledgements and Medals and Members of Their Families to ensure equal right to monthly monetary allowances to common-law spouses, as had been done for legal spouses. In its Recommendation, IHROBiH referred to the decisions of the Constitutional Court of Bosnia and Herzegovina, as well as to the IHROBiH rulings in other similar cases pointing to the unequal treatment of legal spouses and common-law spouses in terms of exercising rights.
